New E-Contract Legal Opinions Now Available

ISLA is pleased to announce that a new set of legal opinions are now available to all ISLA members who subscribe to the ISLA netting opinions service.

The e-contract opinions, that are obtained and published by the International Swaps and Derivatives Association (ISDA), look at the enforceability of electronically confirmed contracts under the laws of various jurisdictions, in the context of transactions and agreements which may be entered into by means of electronic data interchange, or other means of electronic communication.

ISDA are in the process of updating the opinions, and have expanded the agreement coverage to include the Global Master Securities Lending Agreement (GMSLA) published by ISLA.

E-contract opinions for the benefit of ISLA members are currently available for the following jurisdictions, Belgium, Hong Kong, Luxembourg, Ireland, Mauritius, Nigeria, US, Philippines and South Africa. E-contract opinions for over 30 additional jurisdictions will also be available this year.

ISLA netting subscribers will be able to rely on these opinions, and can access them (alongside the ISLA netting opinions) via their existing login to the aosphere website.
